Placement Information & Client Agreement

THIS IS A LEGALLY BINDING CONTRACT. IF NOT FULLY UNDERSTOOD,

CONSULTING WITH AN ATTORNEY BEFORE SIGNING, IS RECOMMENDED.


By clicking "Sign Now", Client AGREES AS FOLLOWS:

The Client has arranged for temporary, permanent and/or contract placement of a “Candidate” through Adirondack Staffing Solutions, LLC (the “Agency”). In the event that the Client wishes to offer any additional temporary, permanent or contract placement to any Candidate referred to it by the Agency within one year from the initial date of referral of such Candidate, the Client agrees to do so only through the Agency and to pay directly to the Agency the applicable regular fees for any and all such services provided by said Candidate. The Client hereby agrees not to directly hire a Candidate that has been placed in the Client’s permanent or temporary position by the Agency for a period of one year after the placement. In the event that the Client violates this term, Client agrees to pay to the Agency immediately, to compensate the Agency for lost income and reimbursement for hiring, employment, and marketing a sum of $1890.00. (Formula: $1200.00 dollars Placement fee, Damages of $600.00 -5% Yearly Advertising costs, $90 labor cost -$30 per hour x 3 hours).


To the extent permitted by law, CLIENT will defend, indemnify, and hold Agency and its parent, subsidiaries, directors, officers, agents, representatives, and employees harmless from all claims, losses, and liabilities (including reasonable attorneys’ fees) to the extent caused by CLIENT’s breach of this Agreement; its failure to discharge its duties and responsibilities set forth in paragraph 2; or the negligence, gross negligence, or willful misconduct of CLIENT or CLIENT’s candidates, officers, employees, or authorized agents in the discharge of those duties and responsibilities.


If given less than 48 hours cancellation of placement request or in the event candidate early dismissal; Client agrees to pay a four (4) hour minimum hourly rate to such Temporary Candidate and the Agency. 

For temporary placement of Candidates, we directly bill Client a rate of $7.00 per hour. We have a wide range of candidates for your office with a variety of skill sets and salary requirements and we understand that every business has different expectations in personnel. We ask that you pay the candidate directly either the day of, shortly thereafter, or with your next payroll, (to your discretion).


For permanent placement of Candidates, we have a permanent placement fee of $1200. Our payment structure allows for the employer to get to know the potential employee or Associate. Upon hiring the Employee, Contractor, or Associate the permanent placement fee of $1200 is not due in one lump sum, but on the following schedule, so the Employee, Contractor, or Associate and the employer can see if they work well together.

  • Employee/Contractor/Associate hire date 1/3 of the referral fee due

  • 30 days later 1/3 of the referral fee due

  • 60 days later 1/3 of the referral fee due


By signing this Staffing Agreement, the undersigned agrees to the foregoing and warrants and represents that he/she is authorized to sign such Agreement on behalf of Client and to so legally bind said Client.

By signing this Client Agreement, the undersigned agrees to the foregoing and warrants and represents that he/she is authorized to sign such Agreement on behalf of Client organization and to so legally bind said Client.
